Has anyone noticed the three different types of graves, the obelisk one the sims 2-like one and the flat one. Has anyone an idea on how to get a certain type when sims die because I need a variety in my sims private graveyard and I know its not random.

I think it has to do with how many Lifetime Happiness rewards were purchased. I haven't had a Sim die yet, so...

I'm not quite sure, it may be related to a combination of things. I'm noticing that the ghost of mine that comes out the most often is the one who was friends with everyone -- while the nicest stone belongs to the guy who had the most lifetime points.

Lifetime happiness greater than or equal to 150000 at time of death gives you the wealthy stone. Lifetime happiness greater than or equal to 75000 at time of death gives you the poor stone. Less than that you probably get the 3rd stone. I found it defined in the urnstone.xml file in gameplaydata.
<kLifetimeHappinessWealthyTombstone value="150000"> <!--If the Sim's lifetime happiness at death is >= this they will have a 'wealthy' tombstone.--> </kLifetimeHappinessWealthyTombstone> <kLifetimeHappinessPoorTombstone value="75000"> <!--If the Sim's lifetime happiness at death is >= this they will have a 'poor' tombstone.-->

That's a good amount. I like that the best headstone requires them to have lived charmed lives.

Does this count any points spent on rewards? I use up the points whenever they've accumulated to anything significant, I had no idea it affected their tombstone.

That I do not know. I'd assume it'd have some kind of running total that's not displayed to the player because it'd be kinda silly to give you the points to buy the rewards and then screw you out of them in the end. After all you still earned those points in your Sim's lifetime so no matter what your Sim still lived a good life.
@thesim456 there's a cheat that adds lifetime happiness points with Awesomemod. There's also a tutorial on how to hack them in with Cheat Engine. Both are available at MATY.

My female founder received the obelisk, and she had spent many points (though she still had about 50,000 banked at death).
